DUNES CITY COUNCIL MINUTES
SPECIAL MEETING
January 15, 2004

1. CALL TO ORDER AND ROLL CALL

    Mayor Rob Ward called the meeting to order at 7:00 p.m.

    PRESENT: Mayor Rob Ward, Councilors, S. Meyer, S. Navetta,
                        M. Miller, J. Martin, and R. Petersdorf.

    EXCUSED: P. Howison

    ALSO PRESENT: City Attorney, Gary Darnielle; City Engineer,
                        Mike McAllister; and Recording Secretary, C. Lewis.

2. PLEDGE OF ALLEGIANCE

Mayor Ward led the Council and audience in the Pledge of Allegiance.

3. OLD BUSINESS

A. Resolution 01-15-04 - A resolution approving the formation of a Water Quality Control Committee for the purpose of maintaining the water quality of all waters of Dunes City.

Ward explained that the intent of the resolution is to formalize the Water Quality Committee that has been meeting regularly since last spring. Ward would like to see a change made in Section 2, a. A City Official appointed as chair by the City Council where there is up to three City Councilors present at the meetings with one Councilor Chairing the Committee. Councilor Miller did not agree with Section 2, c. Those persons specifically appointed by the City Council to the Water Quality Control Committee and all those City residents present at any specific meeting. Miller said that she would like to see the committee set up like the Road Commission where there are certain voting members. Navetta and Ward said that it would be a non-issue. Darnielle suggested changes on Section 1, b. from City agencies to State agencies, and add to Section 1, item f. Adopt bylaws if they choose. Ward said he would rather not adopt bylaws. Darnielle also suggested changing Section 3 to read: The term of the Water Quality Control Committee members shall be continuous until resignation or replacement at the discretion of the City Council.

ACTION: S. Navetta made a motion to approve Resolution 01-15-04: A resolution approving the formation of a Water Quality Control Committee for the purpose of maintaining the water quality of all waters of Dunes City, in its amended form. B. Petersdorf seconded the motion. There were 5 ayes, 0 nays, 1 excused. Motion carried.

ACTION: B. Petersdorf made a motion for the Water Quality Control Committee to come before the City Council to present its bylaws. There was no second. Motion did not carry for lack of a second.

Ward and Navetta will continue to sit on the committee. Miller indicated an interest in the group and volunteered to be a member of the committee.

2. WETLAND/RIPARIAN GRANT

Councilor Martin reported that the grant amounts had changed by eliminating the $2800 for administrative costs and adding $2000 to the staff hours. The grant has been recommended for approval and Martin believes that she will be hearing about the grant in a few days. Ward suggested that when the grant is received, Martin, Riechel and Darnielle review the grant for signature by Joanne Hickey or himself.

ACTION: R. Ward made a motion to authorize Martin, Riechel and Darnielle to review the wetland/riparian grant to be executed by Hickey or himself prior to the next City Council Meeting. B. Petersdorf seconded the motion. There were 5 ayes, 0 nays, 1 excused. Motion carried.

3. PARKS AND RECREATION

ACTION: R. Ward made a motion to recommend that Bob Petersdorf be the second Councilor to be appointed to the Parks and Recreation Committee. M. Miller seconded the motion. There were 5 ayes, 0 nays, 1 excused. Motion carried.

4. EXECUTIVE SESSION

Mayor Ward read the following: This executive session is being held pursuant to ORS 192.660 (1)(h) in regard to consulting with legal counsel about litigation that is likely to be filed. No final action shall be taken during the session.

ACTION: R. Ward made a motion that the City Council, the minutes taker, the city engineer, the city attorney be allowed to attend this executive session. Members of the media may also attend this session and may report on the general subject matter but may not disclose specific information that is not otherwise already in the public record. There was no second or vote.

A. Notice of Intent to Sue - Fish Mill Lodge

Council discussed the Notice of Intent to Sue by Fish Mill Lodge concerning any damage that may have occurred due to City street runoff.

B. Norman and Judy Martin - Culvert Repair

Councilor Judy Martin removed herself from the executive session due to a conflict of interest.

Council discussed the Martin's possible law suit concerning water backing up from the culvert located at Salal and Russell Drive.

14. ADJOURNMENT: Mayor Ward adjourned the meeting at 8:10 P.M.
