DUNES CITY COUNCIL MINUTES
REGULAR MEETING
April 8, 2004

1. CALL TO ORDER AND ROLL CALL

Mayor Rob Ward called the meeting to order at 7:00 p.m.

PRESENT: Mayor R. Ward, Councilors, S. Navetta, J. Martin, S. Meyer, P. Howison, M. Miller, and R. Petersdorf.
ALSO PRESENT: J. Hickey, City Recorder; G. Darnielle, City Attorney; C. Lewis, Recording Secretary; Erin Payne, Siuslaw News; LCAN, and a small number of citizens from the community.

2. PLEDGE OF ALLEGIANCE

Mayor Ward led the Council and audience in the Pledge of Allegiance.

3. APPROVAL OF MINUTES - March 11, 2004

ACTION: B. Petersdorf made a motion to approve the minutes as presented for the March 11, 2004, City Council Meeting. S. Meyer seconded the motion. There were 6 ayes, 0 nays. Motion carried.

4. BILLS OF THE SESSION

The bills of the session for March 12, 2004, through April 8, 2004, totaling $16,289.40, were presented for Council approval.

ACTION: B. Petersdorf made a motion to approve and pay the schedule of bills for the period of March 12, 2004, through April 8, 2004, totaling $16,289.40. J. Martin seconded the motion. There were 6 ayes, 0 nays. Motion carried.

5. RECEIPTS OF THE SESSION

Receipts of the session from March 12, 2004, through April 8, 2004, totaled $37,636.56.

6. ANNOUNCEMENTS AND INFORMATIONAL ITEMS

1. Dunes City Budget Committee Meeting, April 15, 2004, 7 PM.

2. Quarterly volunteer hours due from Committee heads

3. City Hall Spring Clean-up: There was a call for volunteers to help clean up the outside landscape around City Hall with a special request to haul the trash that has accumulated around the river. Volunteers are to meet on May 1st at 9 am. Hot dogs will be provided.

4. The first Parks and Recreation Committee meeting occurs on April 12th at 2 p.m.

5. Mayor Ward made a suggestion that the City could contract with Florence Police Department for additional police service, since Lane County Sheriff's Department and Oregon State Police have reduced staff. Ward stated that a levy of $1 per $1000 of property value would raise approximately $35,000 to fund police service.

A. Mayor's Report - R. Ward

1) Award contract for water meter installation.

Results of the bids to provide and install water meters for the Woahink Water Right Users were as follows:

Councilor Miller commented on a letter that was received by the City from Integrity Plumbing who declined bidding on the project and gave reasons why the job could not be accurately bid upon. Miller thought that Integrity Plumbing had made some valid points in their letter. (See Exhibit A). Mayor Ward clarified that if a property owner has two pumps, two permits would be required. Ward said that pumps for a heat pump would not be monitored.

Dan Reitz of Oregon Water Services was in attendance. Reitz said that the installation would never exceed $214.15, but said that some installations would cost less. Reitz said that on 1 - 2 inch lines from the lake, a 3/4" water meter is normal.

ACTION: B. Petersdorf made a motion to award the water meter installation contract for Woahink Lake Water Right Users to Oregon Waste Services at $214.15 per installation. M. Miller seconded the motion. There were 6 ayes, 0 nays. Motion carried.

Reitz said that he had a comparative cost analysis regarding the reading of the meters. Reitz suggested that the meters be read by the owners once a month, with a contractor reading the meter, as well as doing an inspection of the water meter annually. Reitz said that, for example, to hire a person to read the meter each month would be approximately $200; in comparison to citizen reporting which would cost approximately $96 per month (includes reminder and return postage).

B. Road Commission/Master Road Plan - R. Petersdorf

Road Report (see Exhibit B).

C. Parks & Rec/Tourism/Conservation Committee - M. Miller

Miller reported that the Conservation Committee had looked into the complaint regarding brush removal along the shoreline at the Beck property. The site was visited by boat (Beck denied access to property). After comparing the property to photos taken in the past, the Committee could not determine if there were any changes that had taken place.

Miller said that she had just received in her packet some information regarding the Morris property installing a dock and breakwater. Ward said that the Morris is going through a special permitting process with the Army Corp of Engineers. Joanne Hickey said that the breakwater request has been dropped. Ward suggested Miller could submit her personal opinion through the public process.

D. Site Review Committee - J. Martin

Councilor Martin asked if the Donegan letter had been sent out. Staff will check to make sure the letter has been sent.

E. Police Commissioner/SRFD/Water - S. Navetta

Councilor Navetta reported that there had been a dog complaint regarding Tyler Woosley's dog. Woosley intends to buy the property that he is currently renting and erect a fence for the dog and horse. Woosley will apply for a conditional use permit for the horse.

Navetta said there was a dog bite across the street. Lane County Animal Regulation Authority was contacted and everything went smoothly.

Gary Darnielle reported about the dog complaint from the Wheeler's. Darnielle and Jeannie Cerda did some research and found out that the dog barking would have to be further away than what the Ordinance calls for and since it is only about 50 feet away, the City would have to prove that the barking is a nuisance. Mayor Ward said that at a minimum a letter should be sent to the owner of the barking dog letting them know that if the noise persists, the City will take action.

Darnielle said that the agreement for the Justice Court is pending.

F. Community Center - P. Howison

Councilor Howison presented an estimate of $4400 from Dave Brown for the completion of the excavation of the back wall of the building. There was a discussion regarding the slab at the south entrance of the building. There was a separate estimate, which included tearing out the existing slab, pouring a new slab with the proper slope and drainage, and covering the area with a polycarbonate roof. It was decided to replace the slab, but get a cost break down of the roof installation.

ACTION: P. Howison made a motion to approve the bid from Dave Brown of $4400 to complete the excavation and retain the embankment. (It was noted that the contract is an extension of work done previously and it was not required for the job to go out for bids.) J. Martin seconded the motion. There were 6 ayes, 0 nays. Motion carried.

Howison said that he would talk to the adjacent landowner to rectify the problem of drainage running onto City property.

There was a discussion about possible replacement of the City's septic system. Hickey talked to Lane County and their advice was that if it is not broken, don't fix it. Ward suggested asking someone to access the system. The Council authorized that an emergency shutoff valve be installed on the City's pump. The roof will go out for bid with the roof being replaced next fiscal year.

G. Grants/Franchises/Licenses - S. Meyer

Councilor Meyer received a letter from Charter Communications asking to correct an error to the original agreement.

ACTION: S. Meyer made a motion modify the original agreement with Charter Communications to correct an error. J. Martin seconded the motion. There were 6 ayes, 0 nays. Motion carried.

11. New Business

A. Application for Appointive Office

Rebecca Ruede and Ronald Borge applications for Budget Committee.

ACTION: M. Miller made a motion appoint Rebecca Ruede and Ronald Borge to the Budget Committee. S. Meyer seconded the motion. There were 6 ayes, 0 nays. Motion carried.

B. Resolution 04-08-04 - A resolution certifying Dunes City provides four municipal services enumerated in Section 1, ORS 221.760.

There was a discussion regarding storm sewers as being a provided city service. Ward said it was the same thing as storm drainage that the city provides at its road edges.

ACTION: B. Petersdorf made a motion to adopt Resolution 04-08-04, a resolution certifying Dunes City provides four municipal services enumerated in Section 1, ORS 221.760. M. Miller seconded the motion. There were 4 ayes, 0 nays, 2 abstained (S. Navetta and J. Martin abstained). Motion carried.

12. Unscheduled Items Not Listed on Agenda - None

Mayor Ward read a proclamation declaring May, Mental Health Awareness Month and declare that May 2 - 8, 2004, as Mental Health Counseling Week.

13. Executive Session: Per ORS 192.660, records exempt from public inspection -attorney/client privilege.

The Council recessed to go into executive session at 8:16 P.M.
