1. Call to Order and Roll Call

Mayor Eric Hauptman called the meeting of the Dunes City Council to order at 7:00 p.m.

2. Roll Call

Roll Call was taken by Dunes City Recorder, Amy Graham.

Present: Mayor Eric Hauptman, Council President Peter Howison, Councilor Susie Navetta, Councilor Robert Quandt, Councilor Richard Koehler, Councilor Rebecca Ruede, and Councilor Jamie Mills.

Absent: None

Also Present: Dunes City Recorder Amy Graham, Planning Secretary Lisa Ekelund, Planning Chairman David Bellemore, and 8 individuals.

3. Pledge of Allegiance

All who were present joined in the Pledge of Allegiance.

4. Executive Session

Mayor Hauptman adjourned the regular meeting of the Dunes City Council at 7:01 p.m. to have the Council enter into executive session Per ORS 192.660 (2) (h), to consult with legal counsel regarding litigation.

Mayor Hauptman opened the executive session at 7:02 p.m.

Mayor Hauptman adjourned the executive session at 7:26 p.m. to have the Council enter into regular session.

Mayor Hauptman reconvened the regular session of the Dunes City Council at 7:30 p.m.

5. Consent Agenda

· City Council meeting minutes from 07/06/09 and 07/09/09.

· Bills of the session through 08/07/09.

· Receipts of the session through 08/07/09.

Councilor Quandt made the motion to accept the consent agenda and Councilor Ruede seconded the motion. The motion passed by unanimous vote.

6. Announcements / Correspondence

Mayor Hauptman announced the Festival of the Lakes was held 08/08/09 and he thanked all who participated. The Mayor announced Lisa Ekelund's birthday is tomorrow and everyone present sang The Happy Birthday Song to her. The Mayor announced on 8/29/09 at noon, the Siuslaw Fire and Rescue is having an open house. The Mayor announced that Councilor Howison is leaving in September to visit Dunes City's sister city Dunes, France.

Councilor Howison said he is planning to take gifts to present to Dunes, France.

Councilor Navetta suggested Councilor Howison take Dunes City Tee-shirts.

Amy Graham said she gave the visitors from Dunes, France, Dunes City Tee-shirts when they stopped by City Hall.

Debbie Pasternak spoke from the audience and asked how many Tee-shirts were given.

Amy Graham said she gave the two visitors from Dunes, France a total of 4 Tee-shirts.

Debbie Pasternak spoke from the audience saying that they have 14 Council members.

7. Committee / Commission Reports

· A report was received from Councilor Susie Navetta, Police Commissioner and placed on file.

· The minutes of the Conservation Committee was received by Councilor Howison and placed on file.

· A report of the Parks and Recreation Committee was received by Councilor Ruede and placed on file.

· A report from Councilor Ruede, Fire Commissioner was received and placed on file.

Councilor Ruede asked what the Council feels about business cards for marketing and public relations.

Councilor Howison said he has cards.

Councilor Quandt said when he first came aboard, he was aware that others had cards.

Mayor Hauptman said cards are a good idea and it should be considered an office expense. Mayor Hauptman directed Amy Graham to order business cards for the three newest Councilors.

· A report and minutes of the Road Commission was received by Councilor Quandt and placed on file.

Mayor Hauptman said Councilor Quandt is doing a great job along with the rest of the Road Commission and Mayor Hauptman thanked them.

· A report of the Site Review Committee was received by Jamie Mills and placed on file.

· A report of the Revenue Committee was received by Jamie Mills and placed on file.

· A report of the Stormwater Ordinance Work Group was received by Councilor Quandt and placed on file.

Councilor Koehler asked for clarification about the CCI and asked if the workgroup information should be listed under the CCI portion of the website.

The Mayor said yes.

· A report of the Water Quality Committee was received by Councilor Koehler and placed on file.

Councilor Koehler made the motion that the staff provide the Water Quality Committee with the evaluations and information reports of the septic maintenance program. Councilor Howison seconded the motion. The motion passed by unanimous vote.

· A report and minutes of the Planning Commission was received by Planning Secretary, Lisa Ekelund and placed on file.

· Councilor Navetta said in reference to Communication and Education that a woman spoke to her (Councilor Navetta) about wanting to have aerobic classes in the Dunes City Hall and Councilor Navetta asked what the Council feels about this. Councilor Navetta said this woman would not charge for the class and in return, the woman would like that the City not charge for use of the room.

Councilor Mills said she was concerned of the City's liability and Councilor Quandt agreed with Councilor Mills.

Mayor Hauptman directed Amy Graham to check with the insurance company.

Councilor Navetta said her only concern would be that it would be disruptive to the office.

Councilor Quandt said he believes this is something that should be discussed internally and does not require a motion.

Councilor Navetta said this is the first year that every Councilor has attended the Festival of the Lakes so they have awarded the Councilors each a T- shirt from the Festival of the Lakes.

8. Unfinished / Old Business

· Atkeson property appeal map/tax lot number 19-12-27-40-02200.

Councilor Howison recused himself and took a seat in the audience.

Mayor Hauptman said the purpose of this agenda item is to discuss the topic but not come to a decision.

Mayor Hauptman read a portion of a report received from the City attorney.

Mayor Hauptman said they can only go after the current owner of the property for payment of a fine for abatement or violations.

Mayor Hauptman said the City has received a delineation report from Mr. and Mrs. Skeele.

Councilor Quandt made the motion to defer the determination of the items listed in the notice until the September Council meeting.

Councilor Mills asked if they should add to the motion indicating they will suspend the accrual of the fine.

Mayor Hauptman said they don't need to add to the motion because they have already suspended the accrual of the fine.

Councilor Mills seconded the motion and the motion passed by unanimous vote.

· May nuisance on 5568 Woahink Drive.

Councilor Mills explained the three original complaints filed on the May property.

Councilor Navetta said there was a fourth complaint where there was a building behind the mobile home that was all enclosed and if they took it down it would no longer be a violation.

Councilor Mills said that is gone.

Councilor Navetta said she doesn't believe the side yard setback has come back to the ten-foot mark.

Councilor Mills said they don't have a surveyor so she is asking for guidance from the Council.

Councilor Quandt asked if there were any monuments.

Councilor Mills said they had a marker to measure from the front but she wasn't aware of any markers to measure from the side.

Councilor Navetta said it should be on their plans.

Mayor Hauptman asked if the neighbors are complaining.

Councilor Navetta said no.

Councilor Mills made the motion that the City Council finds a nuisance to exist on the property located at 5568 Woahink Drive and that a structure is built within the 25' setback and needs to be removed. Councilor Koehler seconded the motion. The motion passed by unanimous vote.

· Amendments to the Septic Maintenance Ordinance.

The Council discussed if the staff should send the changes made to the Septic Maintenance Ordinance to DLCD.

Mayor Hauptman directed Amy Graham to send the proposed Septic Maintenance Ordinance amendments to DLCD.

Councilor Koehler said the Water Quality Committee has been doing some adjustments and with additional input from the City Planner, they could evolve them together into one.

The Council discussed how they will approach the creation of the amendments to the Septic Maintenance Ordinance.

 

9. New Business

· Director of Roads job description.

Councilor Quandt said they've been working on this for quite a while and he wants to discuss what this means. Councilor Quandt said they are modifying the Director of Roads job description because they want a Director of Roads that suits the needs of the City. Councilor Quandt said they once had only an Inspector of Roads so they blended the two job descriptions into one. Councilor Quandt said they rolled the wages into one position as well.

Councilor Quandt read the introduction of the position and then gave a summary.

Councilor Navetta asked what if they don't like the performance after 5 months.

Councilor Quandt said then they made a bad decision.

Councilor Navetta said she would be more comfortable with an hourly wage as opposed to an annual wage.

Councilor Quandt said this month they are dealing with the position description but next month they will deal with the contract.

Councilor Navetta asked when they will interview the applicants.

Mayor Hauptman asked since when did the Council interview applicants.

Councilor Quandt said the application will be interviewed before next months meeting and they would like to place an ad right away.

Mayor Hauptman and Councilor Quandt said Councilor Navetta could be present in the interview.

Councilor Quandt extended an invitation to any Councilors who would like to attend the interview.

Councilor Koehler said he agreed with Councilor Navetta to not have an annual contract.

Councilor Quandt said there is a line that specifically addresses this and leaves the option open to the Council. Councilor Quandt said within the wording, the options are open.

Mayor Hauptman said this is just a job description and not an employment contract.

Councilor Ruede said generally an employment contract has a clause for dismissal if they don't like the performance after a period of time.

Councilor Mills suggested that for every place where it says "with the help of the Road Secretary" it should be replaced with "with the help from the appropriate office staff."

Councilor Quandt agreed with Councilor Mills.

Councilor Navetta asked how many hours this person would work.

Councilor Quandt said this would be discussed next month.

Councilor Navetta said no.

Councilor Quandt said they are looking at $12,000 annually and they are looking for 25 hours worked per month.

Councilor Mills said she is divorcing this document from the contract and she is only looking at a job description.

Councilor Ruede made the motion to accept the job description as presented by Councilor Quandt with Councilor Mills' correction. The motion was seconded by councilor Quandt. The motion passed by unanimous vote.

· Resolution Series 2009 No. 2 A Resolution Revising the Job Description for Director of Roads.

Councilor Quandt read Resolution Series 2009 No. 2 in its entirety.

Councilor Mills made the motion to adopt the Resolution Series 2009 No. 2 A Resolution Revising the Job Description for Director of Roads. The motion was seconded by Councilor Quandt. The motion passed by unanimous vote.

· Oregon Recovery Proclamation.

Mayor Hauptman read the Oregon Recovery Proclamation and announced that Dunes City declares the month of September as National Alcohol and Drug Addiction Recovery Month.

· 2009 Road maintenance contract award

Councilor Quandt made the motion to accept all bids and award the 2009 road maintenance contract to Eugene Sand Construction Inc., in the amount of $203,970.00 based on the "engineers' letter of recommendation to award" from The Dyer Partnership. This award is to be conditional upon the requirements in the contract documents. Councilor Howison seconded the motion. The motion passed by unanimous vote.

Councilor Quandt made the motion to grant signing authority for the "notice of award" and the contract documents related to this contracts execution, using a joint signature of the Mayor and the City Recorder after the seven-day protest period has ended. Councilor Howison seconded the motion. The motion passed by unanimous vote.

10. Citizen input on unscheduled items

David Bellemore 83548 Salal St.

David Bellemore said he wanted to compliment staff on the mail log and on the excellence in the record keeping and transparency. David said he just wanted to say the staff is doing and excellent job. David said he applauds the Festival of the Lakes, the Pot Luck, and the Festival of the Lights. David said he wants to point out the necessity of having a 50' shoreland zone. David said he had a table at the Festival of the Lakes and he is willing to help in any way he can. David said he has read research of the vegetation as a bio-filter and the optimal distance is l80'. David said another study said it should be at least 150' for maximum effectiveness so 50' is not bad.

11. Adjournment

There being no further business to come before the City Council,

Councilor Quandt made the motion to adjourn the meeting and Councilor Navetta seconded. The motion passed by unanimous vote.

The meeting of the Dunes City Council adjourned at 9:09 p.m.

The next scheduled meeting of the Dunes City Council is to be held on September 10th, 2009 at 7:00 p.m.

Parks and Recreation Commission Report

For August 13, 2009

The Parks and Rec Commission did not hold a regular meeting in July.  Our next scheduled meeting will be September 17th @ 7pm .  

We have an opening for a new commissioner to be appointed.  Please contact me or Amy, our city recorder, for more information.  

Many thanks to Bob Petersdorf, Larry Johnson and John Pinto for continuing to support Dunes City by volunteering to groom and mow  Byrd Park and Petersdorf Park . I understand that he, along with his brother in law Larry Johnson, have been mowing and caring for these parks over 25 years.   

These good folks exemplify the spirit of volunteerism in the community.  Over the years volunteers have saved Dunes City thousands of dollars in expenses.  Again, Thank you.  

Along those lines, if you have an interest in volunteerism related to our parks, please come by and talk to me or any other commissioner or city council member.   

Fire Commissioner Report  

I attended the meeting of the West Lane Emergency Operations Group on July 20th.  The discussion continues to be centered on disaster readiness for Florence and Dunes City .  

I would like to thank Bret Finegold for also attending and giving professional support.   .  For those who may not be aware:  Brett is our citizen representative to that group.

  DUNES CITY ROADS COMMISSION

Report to Council

August 13th 2009  

The Dunes City Road Commission announced the list of streets to be maintained as a part of this year's maintenance program. Construction will occur later this summer on more than 20 streets owned by the City. The projects have been out for bid and tonight we will be awarding the contract based on a bid tabulation, analysis and letter of recommendation to award, from city's engineering firm the Dyer Partnership.

The maintenance will impact the residents using these streets during construction and everyone who uses the streets to visit or conduct business will be temporarily inconvenienced as well.

A large portion of this maintenance is being funded by a Federal Grant for $94,000 that will pay for a significant amount of the Slurry Seal projects. "This is `Small Cities' stimulus money that is being put to use in our local community,"

The Dunes City Road Commission plans to conduct a presentation in August to familiarize residents, and anyone else who is interested, with the maintenance planned providing specific emphasis on Slurry Seals; what they are and how to drive on them on the day of curing. Presentations will be scheduled based on the number of people who indicate an interest. If you are interested in attending a 30 minute presentation please send an email to dunescityroads[at]charterinternet.com indicating the number of people interested in attending. If you do not have email, call Dunes City Hall at 541-997-3338.

In an effort to communicate with Dunes City residents and others who wish to be kept abreast of road maintenance details, the City is encouraging people to send them their name(s) and email address. This information will be kept confidential and used exclusively for the purpose of communicating about road maintenance status and upcoming road maintenance events. You can submit your email address to dunescityroads[at]charterinternet.com and put "Road Maintenance" in the subject field. Everyone who provides their email address will help the City save publication and postage expense as direct mail will be the other communication option (If you provide your name and email address you will not be notified by regular mail).

SITE REVIEW COMMITTEE REPORT

August, 2009  

The Site Review Committee did not meet in June, however, the chairman and one member were asked by the Dunes City Recorder to “look into” verbal complaints that had been called into the office as follows:  

1.                  Complaint that property owner was spreading RV septage on plants and yard in residential neighborhood.

Action Taken:  Referred matter to Lane County Public Health and Safety.  

2.                  Complaint that individual was residing in RV on residential property.

Action Taken:  In absence of committee chair, committee member made several site inspections at various times and determined there was no one living in the RV.  

3.                  Complaint that property owner was constructing a structure without a permit.

Action taken:  Site visit done and determination that violation of setback requirements may be taking place.  Referred matter to Dunes City Planning Department for further action.  

4.                  Complaint of piles of brush constituting fire hazards – three separate locations.

Action Taken:  Matter referred to Siuslaw Valley Fire Marshal for further action.  

Pending Written Complaints:  

1.         The abandoned trailer has been removed from Dunes City ’s property.  

2.                  A drive by visit to the property with the excessive number of vehicles off Buckskin Bob’s Camp reveals that there remain seven vehicles, however, two of them were newer vehicles that may have just been company visiting the owner.  It appears there are four cars in varying stages of repair and one inoperable track hoe on the property.  The other vehicles appear to be operable and currently licensed.  Clearly the property owner has attempted to abate the nuisance, but has not fully completed the process.  The Site Review Committee is scheduled to meet on August 12th at 11:00 a.m. at Dunes City Hall .  At that time, the committee will discuss the matter further and make recommendation as to the next steps.

Dunes City Revenue Committee Report

August, 2009  

In the absence of chairman Mills, the Revenue Committee met under the leadership of Vice Chairman John Stead on Wednesday, July 8th, at 3:00 p.m. in the Dunes City Council chambers.  

At the meeting, the members present discussed system development charges, which lead into a discussion of street lights.  The Recorder indicated that Dunes City currently pays about $1200 a month for street lights.  The Recorder was asked to look in to whether the City is paying for street lights on county roads as well.  

Discussion was had regarding whether Dunes City residents are receiving the benefit of the more than $300,000 they pay in county taxes.  

A discussion was had regarding the suggestion of establishing a burn permit.  The consensus of the members present was that it wouldn’t be worth pursuing.  

Except for brief discussions on the number of committee members present needed for a quorum and a request from the City Recorder as to what grants have been applied for, the remainder of the meeting was used to craft language for the draft business license ordinance.  

The following grants have been applied for:  

U. S. Environmental Protection Agency “Community Action for a Renewed Environment (CARE) Program - $89,975.00.  A decision regarding the award of the request has not been made.  

Oregon Department of Environmental Quality, Clean Water Revolving Fund grant offered with federal ARRA (stimulus) money - $600,000.  Notification has been received that Dunes City did not receive this award.  Chairman Mills attending the Small Cities Water and Wastewater Infrastructure Funding class in Roseburg on July 16th, where she had an opportunity to meeting with Rick Watters, who is in charge of these grants/loans, and his immediate supervisor, John Brugger.  Chairman Mills has been assured that Dunes City ’s application has been rolled into DEQ’s regular grant/loan program for consideration.  

According to Diana Evans, Coastal Grants coordinator, Dunes City , via Larry Lewis, made application for the 2009-10 Coastal Planning Grat in the amount of $3,000.

According to the Planning Assistance Grants announcement, the Special Planning/Technical Assistance Grant can only be used to receive technical assistant in planning for multi-jurisdictional urban growth, including completing resource and hazard inventories in urban growth areas.  Chairman Mills is unaware of any planning projects that fit the goals and objectives of this funding opportunity.

A Stormwater Pollution Control grant request, which, according to Amanda Punton, Nonpoint Grants Manager, does not have a deadline date, was prepared by Chairman Mills and submitted to the City Recorder, the Mayor, and to Councilor Quandt for review and comment.  Upon request of the Mayor, Chairman Mills re-drafted the grant proposal and submitted the same to the City Recorder for finalization and submittal on July 30, 2009 .  

A grant opportunity exists for Dunes City to seek funding under the Energy Efficiency and Conservation Block Grants if they intend to construct or remodel their building or to develop a community-wide program to improve energy efficiency and reduce fossil fuel usage.  An inquiry as to interest was sent to Dunes City council members, the Mayor and the City Recorder on August 4, 2009 .  

A grant opportunity exists for Dunes City to seek funding under the Oregon Parks and Recreation Department’s Land and Water Conservation Fund.  The Revenue Committee has not be notified whether the Parks and Recreation Commission or the Water Quality Committee desire to make application for such funding, which can be used to either acquire land for public outdoor recreation or to develop basic outdoor recreation facilities.  The deadline for the application is November 2nd.  

State grants for public housing energy efficiency, broadband initiatives and public housing capital funding for stalled projects opportunity were not applied for as Dunes City does not have current programs or the qualifications to apply for such funding.  

During the month of July, federal grant opportunities offered by 42 federal agencies were explored.  Attached is a list of some of the federal grant opportunities that were explored and investigated and a determination made that Dunes City does not have current programs or the qualifications to apply for such grant funding.

STORMWATER ORDINANCE WORK GROUP

COUNCIL REPORT

August 13th 2009 Report to Council  

The City has formed a workgroup to revise and. produce a new draft Stormwater ordinance. Based on nearly unanimous opinion that the Stormwater ordinance needed to be reworked. The City went through the process of collecting opinions from the commissions and a CCI formed to give the Citizens the opportunity to give input on the subject. The CCI enabled this workgroup, its members and its directive.  

The workgroups directive is:

To provide a draft of a stormwater ordinance that takes into account previous drafts of the ordinance, recommendations from the Commissions, input from the CCIs public record, and any new input received and then bring this new draft back to the CCI for review.  

The workgroup members tasked with this directive are:

In my opinion we have assembled a workgroup with diverse opinions and the appropriate skill sets to accomplish this task. Since this will be a long process, we decided at the last CCI meeting that I would produce a monthly progress report for the council and the public.  

Our first meeting was last week August 6th 2009 . We compiled the source materials we will be using. We discussed our meeting schedule, the directive of the group and the strategy for accomplishing this task. We hope to be meeting every two weeks and I will be summarizing the progress of those meetings in my monthly council report.                                                                                                                Robert Quandt/Stormwater work group Chair

Water Quality Committee

City Council Report

8-13-09  

The committee reviewed concerns of each member.  As the Septic Maintenance Ordinance has been a water quality concern over the years we reviewed the changes made so far and discussed fine tuning the work done so far.  Those changes are still in process.  The completed ordinance will be available for review at the next council meeting in September.  

On the same subject, the committee moved to have staff provide a monthly report on the Septic Maintenance program to the this committee.  

The two points we are watching and acting on are the Gibbs Creek and Ford Way area of Woahink Lake .   

Siltcoos and results from the 303d EPA study have yet to be completed by Portland State and the DEQ.  

On a continuing note of concern; this committee will draft an Inter Governmental Agreement with Lane County in order that we may cooperate to assure water quality concerns so that water users locally have cooperation from Lane County as well.  This will be presented in draft form at this coming Water Quality Meeting on the 19th of this month and for your review in September. 

Volunteer efforts to help residents with resource stewardship information were enabled by the good energy of all members of this committee during the fourth annual Festival of the Lakes.  Thank you all for attending.  It was a great turn out and everyone both learned a lot and had quite a pleasant day.

DUNES CITY COUNCIL

PLANNING DEPARTMENT STAFF REPORT

AUGUST 2009

 

The last Planning Commission and CCI meeting was held on July 16th. At this meeting, the Planning Commission discussed a staff report concerning a large pile of dirt allegedly located within the shoreland zone on property located at 83421 Hwy 101. The staff report stated that there were no violations consisting of piles of dirt within the shoreland zone and the Planning Commission unanimously voted to accept the staff report as presented.  

After the Planning Commission adjourned their meeting, the CCI chairman called the CCI meeting to order. In the CCI meeting, the motion to form a stormwater work group was unanimously approved. The Planning Staff has been assisting the members of the workgroup as needed.  

The next regular meeting of the Planning Commission is scheduled for August 27th at 6:00 p.m. where they will hold a public hearing for an application for amendment to an Ordinance/Dunes City code. Notice for this public hearing was mailed to the appropriate property owners on August 5th and it was advertised in The Siuslaw News on August 12th. The purpose for the proposed amendment is to change the language of Dunes City Code § 155.2.3.400(B)(2)(e) to state, "Livestock, unconfined pets or domesticated animals are prohibited". The Planning Commission will ultimately make a recommendation to the City Council who will hold a public hearing on September 1Oth at 7:00 p.m. to consider the adoption of the amendment.  

Within the month of July Dunes City issued 6 permits.  

Winstead and Associates (our new building official and inspectors) have recently changed the name of their building services division to Building Codes Consultancy. The transition from The Building Department to Building Codes Consultancy went as anticipated. Planning staff foresees a good working relationship with this new company.
