1.     Call to Order  

The Planning Commission meeting was called to order by Planning Chairman, David Bellemore at 6:14 p.m.  

2.     Roll Call

 

Roll Call was taken by City Planner, Lisa Ekelund .  

Present:    Planning Chairman David Bellemore , Commissioner Tom Bassett , Commissioner Ken Henderson , Commissioner Marilyn Miller , Commissioner Ken Platt , and Commissioner Lee Riechel .  

Absent:     None  

Others Present:    City Planner, Lisa Ekelund , City Recorder , Fred Hilden ,
                                    and 2 individuals.  

3.     Pledge of Allegiance  

All who were present stood for the Pledge of Allegiance.  

4.     Approval of the Revised Agenda  

Commissioner Henderson made the motion to approve the revised agenda.  Commissioner Miller seconded the motion.  The motion passed by unanimous vote.  

5.     Approval of the 04/22/10 meeting minutes  

Commissioner Miller said on page three in the fifth paragraph she would like to remove the word "not" before "be able to build."  Commissioner Miller said on page three in the seventh paragraph she would like to change the word "irrelevant" to "relevant".  

Commissioner Bassett made the motion to accept the minutes of 4/22/10 as amended. Commissioner Miller seconded the motion.  The motion passed by unanimous vote.  

 

6.     Announcements / Correspondence  

Chairman Bellemore announced his resignation as Chairman effective July 2010.  Chairman Bellemore said he would continue as a Commissioner.  

7.     Citizen Input  

There was no citizen input.

 

8.     Unfinished / Old Business  

  • Final Plat application for Woahink Ridge Estates – Public comment on Woahink Ridge Final Plat application.

Chairman Bellemore said the scope of the Planning Commission's action on this agenda item is whether the Woahink Ridge Estates final PUD application is in compliance with and substantially conforms to the terms and conditions of approval of the preliminary Woahink Ridge Estates PUD plan and plat, as set out in the 9/14/09 settlement agreement between the City and developers, as well as the applicable Dunes City Code provisions set out in the Planning Department’s staff report and findings of fact, dated 6/08/10.  Chairman Bellemore said this agenda item is not a quasi-judicial procedure or a land use or limited land use decision, as defined under statute, but rather more of a non-discretionary decision.  Chairman Bellemore asked if any of the Commissioners have any questions about the scope of this agenda item.  

Commissioner Henderson said that under the table of contents, the transmittal letter written by Ronald G. Mann is not dated.  

Lisa Ekelund said the letter was received with the entire application along with payment on 5/5/10 .  

Chairman Bellemore asked if there were any questions about the scope of this agenda item and no one responded.  

Chairman Bellemore asked if all of the Commissioners had an opportunity to review the final PUD application as received from the developers.  All of the Commissioners said they had the opportunity to review the final application.  

Chairman Bellemore asked if the Commissioners have any questions regarding the final PUD application and none of the Commissioners had any questions.  

Chairman Bellemore asked the City Planner, Lisa Ekelund , to read the purpose, description, and recommendation from the staff report / findings of fact and also to read the final engineering report.  Chairman Bellemore said he would not have staff read the entire report because all of the Commissioners had gone through the application and all requirements have been met.  

Lisa Ekelund read the report as directed by the Chairman.  

Chairman Bellemore asked if any of the Commissioners have any questions regarding the reports.  

Commissioner Miller asked if Ron Mann received the report and Mr. Mann said he had received the report when he arrived this evening.  

Chairman Bellemore opened the agenda item for public comment at 6:34 p.m.  

Chairman Bellemore asked if there is anyone in the audience that would like to comment on the Woahink Ridge Estates Final PUD Application and there was no public comment.  

Chairman Bellemore closed the agenda item for public comment at 6:35 p.m.  

Chairman Bellemore asked if any of the Commissioners have any additional questions.  

Commissioner Riechel said he is not sure if there is a requirement for a final plat and plan approval to be open to public comment. Commissioner Riechel said the public comment makes this quite close to being a public hearing instead of a public meeting.  

Chairman Bellemore said the agenda was revised because the City Attorney advised the City Recorder that the Commission should have a public comment period.  

City Recorder , Fred Hilden said that is why the specific language was prepared at the opening of the agenda item.  Fred Hilden said this is just an opportunity for people to comment.  

Commissioner Riechel said it is entirely appropriate with something this complex.  

Chairman Bellemore said it makes the whole process transparent.  Chairman Bellemore asked if anyone would like to entertain a motion.  

Commissioner Platt made the motion to approve the final Planned Unit Development application for Woahink Ridge Estates and direct the City Recorder to certify the Planning Commission's action and arrange to have the final PUD application and a draft of the appropriate ordinance forwarded to the City Council for review and final approval.  Commissioner Miller seconded the motion.   

Commissioner Riechel questioned if the Planning Commission needed to take any action regarding the vacation of the road.  

City Recorder , Fred Hilden said the vacation of the road is a separate matter to be addressed by the City Council.   

Commissioner Riechel asked if the Planning Commission needed to take any action regarding the zone change.  

City Recorder , Fred Hilden said the zone change had already been approved by Ordinance Number 189.  

The motion to approve the final Planned Unit Development application for Woahink Ridge Estates and direct the City Recorder to certify the Planning Commission's action and arrange to have the final PUD application and a draft of the appropriate ordinance forwarded to the City Council for review and final approval passed by unanimous vote.  

9.     Unscheduled items not listed on the agenda  

Commissioner Bassett asked about the Atkeson gazebo.   Lisa Ekelund said the gazebo has been removed by direction of the City Council.

 

10.            Adjournment  

There being no further business to come before the Planning Commission, Commissioner Miller made the motion to adjourn the meeting.  Commissioner Platt seconded the motion.  The motion passed by unanimous vote.

The meeting of the Dunes City Planning Commission adjourned at 6:47 p.m.
