A.               Call to Order and Roll Call

 

The meeting was called to order at 6:30 p.m. by Bob Petersdorf.  Maria McConnell called the roll call.

 

Present:       Bob Petersdorf, David Persons,  Jo Owens, Bill Connell, Lee Reichel  and Maria McConnell were present.                   

 

B.               Approval of Minutes April 21, 2008  

Action          

          Bill Connell made a motion to approve the April 21, 2008  Dunes City Road Minutes as presented David Persons seconded the motion.  The motion was carried by 5 ayes, 0 nays and the Minutes were unanimously approved

           

C.                 Citizen Input  

None

D.  Unfinished/Old Business:  

DP selection made for the chip seal was well done.  We could use a lot of sweepers and the city roads are in good condition.

Jo Owens is this based on a dollar value

BPeter we will wait for the budget and then we will prioritize which roads will be repaired first.

DPersons one road that is in better shape is Osprey it is the least needy.

Lee we need the streets swept and cleaned we need to get.  

2.  Approval of Right-of-Way Placement Permit for Jan Sandoval.  RP reviewed the memo written by Jan Sandoval and letter from Chelsea .  I talked to peopleon Woodland Lane and it is a can of worms; the lines should have never gone in where they went in and we have so many lawsuits .  there’s a public easement and the water lines were put in the wrong place.  In talking with the City Recorder and the Mayor and this is a civil problem.  Ms. Sandoval has the right to run her lines down the easement.  I don’t know why the Road Commission is even involved in this.  All we can do is give you the right to run your lines in the city’s right-of-way.  At this time the public is allowed to come forward and speak on this item and Charlsie is here to address the issue.

 

Jan Sandoval, 83555 Woodland Lane , was recognized and addressed the Commission and members of the audience.  She reviewed a letter received from

Charlsie giving her a time limit to correct the problem.  I’ve been working on this for 5 years and she explained the difficulties she is having and “the hazardous danger” and why can’t I get some cooperation from everyone here to help me out.  I have a plumbing, electrical a right-of-way permit.  I am looking at about $5,000 in costs and Mr. Gregor has offered us his services.  I have a husband with Parkinsons and I am on limited income and I welcome anyone suggestions to help me out.  I have heard that $900 is too much money to spend and this is not my problem.   

Man in back row offered some solutions.  I talked to the building department and told them this has to be a community effort to get this done.  No one in the bureaucracy wants to take a leading role.  It might take the electrical inspector to cite every person.  No one wants to take a leadership role or spend any money.  Ken has agreed to do the trenching which will save a lot of money.   

Jan I am here to comply and I am at an impasse.  I’m not asking that everyone be cited.  Do I file a formal complaint or do we all work together.  

Diane Diffenburger this was all legal when it was put in.  Why can’t they just put some fill in and not dig the whole trench out and be done a lot cheaper.  

The pipes have been there for 20 years and haven’t caused a problem.  The RC has come out because the dirt was washing out because that is a natural waterway.  

Ken Gregor I am right on the property next to the lane.  S

Meone has to give Jan the row.  But no ones giving her permission and everyone else has a pipe in there.  These lines are old, not buried correctly and last year it plugged out property.  There was a leak for over a month.  For Jan Sandoval she needs permission.  

RP everyone around there has the right to use that easement.   

JSandoval reviewed all her permits.  

Charlsie Discussion ensued as to who owns that easement.  Ms. Gregor stated they want these lines off of there.  

The dirt on top may work, any pvc cannot be in the sunlight, where is the tracer light.  Current code, no tracer, The conduit on Mr. tillman’s lot was a disaster waiting to happen.  It is unfortunate that no one wants to work together.  No one wants to herd these cats, I will notify all the property owners involved and I will cite them.  Until Mr. tillman called me, wedont know where all the issues are and I would be negligent in my duties not to address it.  We are not heartless bureaucrats but this has to be corrected.  I will attend a meeting to help resolve this situation.  As for putting a couple loads of dirt, it will just wash down.   

Site Committee???  Charlsie we do have some code problems.   

RP offered the city hall facility to hold a meeting to resolve this.

RP she has permission to go down the city.  The lawsuits that could come out of this are no comparison to the cost of $900.  

RP they think other commissions can solve the problems;  

Ms. Perrin, I just lost my husband and I think this is going to be costly to me, I have a house that is 72 years old.

Chuck , 83510 Fairmont road, that is not an easement, it is a dedicated road.  In 1981 we built our house on Woodland Lane .  The inspector’s didn’t inspect.  The water master drew them out a plan.  There’s a progressive easement and they can be allowed.   

RP dedicated easement that a city owns.  RP I was over there at the county and there was no record that the city owned these easements. 

Herb put that subdivision in;  Ms. Perrin don’t you own the property on the side of the road.

Chet’s Trail is an easement same as Fran

Who pays the property tax on it? Who owns it?  Francis Bay Lane .

I will check with Ruby to see if they have the original maps.  RP.

Jan Sandoval asked if she is going to be granted an extension. 

 

Charlsie stated she would not give her a deadline date.  

New Business:  

1.       RP reviewed the 2009 Special City Allotment Grant Program.  Grants don’t like to give money to dead end streets.  Huckleberry and Woodland .  Bill Connell asked him to widen Cloud Nine Road .   

          Do we want to pursue Cloud Nine Road ; if we chip seal Huckleberry.  Lee Rwe can’t do anything on Cloud Nine.  I’ll work on this grant.  

2.       RP reviewed the ODOT Pedestrian and Bicycle Grants.   The only place I can think of is Chet’s Trail.  I had the Audobon people interested once.   

          Jo Owens some people may want it.  RP I think we should red flag it and put it in the calendar for January of 2009 as a consideration for next year.  Put this in the tickler file.  

3.       Purchase Order Requisitions.  Bob Petersdorf reviewed the requirements for any purchases in excess of $50.00.   

          Jo Owens stated that the audit that was conducted revealed a lot of oversights in the past which necessitated the new for a new procedure.                                                          

          G.      Unscheduled Items Not Listed on Agenda

 

Youth Legacy Program – put this on the definite maybe for the future.

Reviewed the address list and corrections noted.  Letter to Robin and Jamie Mills for an application for driveway permit.

 

          Email from Greg Perkins regarding Dunes City Public Works Construction Standards bidding specifications for road projects.

 

          Dave Persons stated he inspected the trees Ms. Allister was complaining about and did not discover any insects. 

 

H.      Reports:

                   

          1.       Keith Herring, Road Inspector, was not present at tonight’s meeting.

 

          Action:  

2.  Maria McConnell, Road Secretary – Nothing to report at this time.          

3.  Bill Connell, Road Commissioner – nothing to report  

4.  Linda Lauck, Road Commissioner – absent and excused.    

5.  David Persons – I had a report from a neighbor that on Ford Way on the left hand side, there is a dead tree and it is listing and ready to fall.  RP I think its on Don Davidson’s property.  

6.       Lee Reichel, Road Commissioner – we missed our timing on getting an appropriate notice to the newspaper on the subdivision, we have scheduled a special meeting on June 5, 2008 .  We have received back from ALCOG they are recommending disapproval.  One of the issues is the placement of the road because it goes through one of the last standing lot of trees.  The code says you will do your utmost to preserve the trees.  LR reviewed the plans with the Road Commission members.  If the city denies it, they will appeal it.   

RP recommended a site review by the members of the Road Commission.

In order to get a consensus of the Road Commission members and make recommendations to the Planning Commission.  

The Planning Commission is also reviewing a Conditional Use Permit for a boat dock.

9.       Bob Petersdorf, Road Chairperson – nothing to report, wished everyone a good Memorial Day weekend.

Bill Connell, David Persons made the motion to adjourn, seconded by _________________________and unanimously approved by 5 ayes, 0 nays. Motion carried.

 

The next regularly scheduled Road Commission meeting will begin at 6:30 p.m. on June 16, 2008 .
