DUNES CITY ROAD COMMISSION

1.     Call to Order  

The Road Commission meeting was called to order by Road Chairman, Troy Sathe at 6:35 pm .  

2.     Roll Call  

Roll Call was taken by Road Secretary, Selena Carter .  

Present:    Road Chairman Troy Sathe, Commissioner Henry Leach, Commissioner Jerry Curran, and Commissioner Bill Harris .  

Absent:     Commissioner Mike Smith and Commissioner Ron Tucker (excused).  

Others Present:    Road Secretary, Selena Carter, Joanne Hickey, Tom Bassett, Rich Bailey, and Bill Sathe.  

3.     Pledge of Allegiance  

All who were present stood for the Pledge of Allegiance.  

4.     Approval of the Agenda  

Commissioner Curran made a motion to approve the Agenda as written.  Commissioner Harris seconded the motion.  The motion passed by unanimous vote.  

5.     Approval of the 4/20/2011 meeting minutes  

Commissioner Curran made a motion to accept the minutes of 4/20/2011 as amended.  Commissioner Leach seconded the motion.  The motion passed by unanimous vote.  

6.     Announcements / Correspondence  

·        Discussion on Street vacation on Buckskin Bob  

Discussed under Citizen input.  

·        Trees on right-of-way by Parkway (by Jamie Mill’s house) & trees on Parkway by turnaround (by Joanne Hickey’s house)  

Discussed under Citizen input.  

·        Trees on Wright Road  

Chairman Sathe stated Dunes City has not received any information from PUD to find out if they are willing to take the trees below the power lines.  

Commissioner Curran stated he talked to Fred and PUD is very willing to help out but no decisions have been made yet.  

7.     Citizen Input  

Joanne Hickey, Dunes City  

Joanne Hickey stated she emailed her original letter about the danger of the tree to Dunes City .  

Joanne stated there was a question of whether the tree was in the road right-of-way.  She said before she moved into her home she had a couple trees removed at her expense.  She said there is a tree that appears to be damaged and she would like to have it removed.  Joanne asks the Road Commission that the tree be removed for her safety.  

Commissioner Harris stated there are professional arborists and he would prefer to have a professional arborist give an opinion on the tree.  

Commissioner Curran stated he would also like to have a professional look at it.  He personally thinks that the tree is fine and that if there was a storm it probably would not hit the house.  

Joanne stated that cutting into the tree and taking core samples from it doesn’t necessarily show damage from it.  

Commissioner Harris stated he doesn’t feel a core sample is necessary but just a visual look at the tree.  

Commissioner Leach stated he has a visual map that shows other trees that would be more dangerous than the tree in question.  

Chairman Sathe stated the Road Commission has set a presence if there were big trees that were threatening they would be taken care of.  

Commissioner Leach stated what he is hearing is that Commissioner Harris and Curran want the tree to be examined for disease.  Commissioner Leach stated if the tree is healthy then there is no need to remove it.  

Commissioner Leach stated he doesn’t like to take healthy trees out unless they are imminent danger and if you count one then you count them all because they are all big trees.  He stated as a hundred foot property line there, he can’t believe that the tree is not way in the back out of the way and if it falls it’s a one and a hundred chance that it’s going to fall directly on the house.   

Commissioner Curran states the topography on Parkway is such that the chance of it hitting Joanne’s house is very minimal.  He said it’s going to fall downhill and Joanne’s house is downhill but the angle that the tree is on he doesn’t think that it would go anywhere near her house.  He said that he can’t call the future either.  Commissioner Curran states if it is a healthy tree then it should be kept there and if it is a diseased tree then it should be removed.  

Joanne stated so in the future she knows that the Road Commission’s attitude about removing potential trees in the right-of-way that can damage people’s property has changed.  

Chairman Sathe asked Joanne if she can take into consideration that he does not agree with the Road Commission.  

Joanne thanked the Road Commission for their time.  

Commissioner Leach made a motion that the tree in question be checked by an arborist.  Commissioner Leach amended his motion to state that the three trees they have looked at on Parkway be checked by an arborist and if an arborist deems them to be unsafe then the commission would agree to have them removed. Commissioner Harris seconded the motion.  The motion passed by unanimous vote.  

Tom Bassett, Dunes City  

Tom stated this is in reference to the original request to vacate the end of Buckskin Bob Road .  He stated subsequently that there were some questions on whether it was appropriate or not to vacate the whole end of the street.  He stated that neither the Davis’s nor he and Rich were requesting the vacation for more property other than to allow their house to conform to set backs and make the Davis’s have some way of stopping the traffic coming across their driveway and also to put in a well.  He stated they got together to revise their request to the city and they are asking for two triangles one on each side.  One, which is on Tom and Rich’s property where they park their cars, will be incompliance with their property and the other side is on the Davis ’s property.  He said that will allow a 30’ section instead of a 50’ section that goes down into the water.  He said they were told that they would have to have 2/3 of a vote from anyone that is within 400’ of the vacation and they have received that.  He said he would like to ask the Road Commission to deny the request for the full vacation they sent to the City Council.  He asked the Road Commission revisits their current request.  He showed the Road Commission the new request for the vacation of Buckskin Bob Road .   

Commissioner Curran stated he thinks that the Road Commission needs some time to digest the information presented by Tom and they are not going to make a decision on it tonight.  

Commissioner Curran stated he does not have a problem with the triangle presented by Tom and Rich.  Commissioner Curran stated he has a problem with the Davis ’s triangle being he feels that we are giving him some land so he can build a well.  Commissioner Curran stated he thinks the Davis ’s should pay for it.  

Commissioner Curran stated the Road Commission should look at the possibility of putting a sign at the end of Buckskin Bob and being proactive out there.  

Commissioner Harris stated he is new to the council and went out to Buckskin Bob and couldn’t figure out what was what.

Tom stated he would be more than willing to show Commissioner Harris the area they are requesting to vacate.  

Chairman Sathe stated the Road Commission needs to pick a date to go look at Buckskin Bob vacation and that will extend their meeting.  

Commissioner Curran stated his recommendation would be to go out on May 23, 2011 at 5:30pm to look at the Buckskin Bob property.  

8.     Unfinished / Old Business  

·        Update by Commissioner Curran and Ron Tucker regarding street ownership.  

Commissioner Curran has nothing new to report.  

·        Bid from Dyer Partnership & Gary Baker.  

Selena stated the bids will be presented at the next Road Commission meeting on June 20, 2011 .  

·        Update on Shady Lane & Laguna verification.  

Selena passed out the current email from Mike Jackson from Lane County that states Shady Lane is private.  

Selena pulled up on the computer a map of Shady Lane and a deed from a property owner that shows the property owner does own part of Shady Lane , making it a private road.  

9.     New Business

  • Discussion on 2011-2012 Projects.

Chairman Sathe stated there are two thoughts of theory on the 2011-2012 projects.  He said since we have the roads at a pci of 82% it might be a good idea this year to not conduct any slurry seal.  He said the Road Commission should go out as a Commission and look at the slurry seals that have been done so far to see how they are holding up and what the Commission thinks of it.  

Chairman Sathe stated another option would be to go ahead with the slurry seals for 2011-2012.  

Commissioner Curran asked Chairman Sathe what was in line for the 2011-2012 slurry seal.  

Chairman Sathe stated the streets are Hilltop, Osprey, Spruce and a couple more.  

Commissioner Harris stated he would like to see trimming done on Hilltop, Osprey, and some on Parkway.  

Chairman Sathe stated we have money in the budget set aside for trimming.  

Chairman Sathe stated he does not want the Road Commission to make a decision tonight because he would like to have the whole Road Commission at the meeting to give their input, but to think about what the Road Commission would like to do for 2011-2012 Projects.  

There was a lengthy discussion on dividing up and inspecting all of Dunes City Streets to see what kind of condition they are in and if anything needs to be done on them.  

  • Letter from Mike Cocciolo re: Greengate Road Gap.

Chairman Sathe stated the Letter from Mike Cocciolo is information for the Road Commission.   

Chairman Sathe stated this is not a Road Commission issue because the past Road Commission had ruled on the Gap.  

Chairman Sathe explained to the Road Commission that an Ad Hoc Committee has been formed to deal with the issue.  

10.             Unscheduled Items Not Listed on the Agenda - None  

11.             Final Comments  

Road Secretary Selena had nothing to add.  

Commissioner Leach stated Dunes City seems to be where everyone has their own personal agenda. He said he does not like a lot of the stuff under the guides of it’s for a good purpose.  He said the citizens want us to agree with them and he feels that we should not have to agree with them for their own whims.  He said it is not helping the citizens of Dunes City ; it is helping somebody help themselves.  

Commissioner Curran stated it was a good meeting and a lot got accomplished.  

Commissioner Harris stated he agrees with Commissioner Leach and Curran about tonight being a good meeting and personal agendas.   

Chairman Sathe stated that Commissioner Harris has stepped forward and jumped right in and is a really good asset to the Road Commission.  

12.             Adjournment  

There being no further business to come before the Road Commission, Commissioner Leach Leach made a motion to adjourn the meeting.  Commissioner Curran seconded the motion.  The motion passed by unanimous vote.  

The meeting of the Dunes City Road Commission adjourned at 8:38 pm .
