AN ORDINANCE AMENDING CHAPTER 32 OF THE CODE OF DUNES CITY TO ELIMINATE TERM LIMITS, DEFINE A QUORUM, ESTABLISH THE VOTING RIGHTS OF THE CHAIRPERSON, AND TO CHANGE THE TIME LIMIT FOR COMMISSION ACTION

            WHEREAS, the City Council is interested in modifying the general procedures regarding the operation of the Dunes City Planning Commission.

           

            NOW THEREFORE, Dunes City ordains as follows:

 

Section 1. Section 32.61 of the Code of Dunes City, is amended by the addition of a Subsection (D):

 

(D)       Three members of the Commission shall constitute a quorum.

 

Section 2. Section 32.62(B) of the Code of Dunes City, is amended by the addition of a Subsection (C):

 

(C)       The Chairperson shall vote only when a tie occurs.

 

Section 3. Section 32.63 of the Code of Dunes City, is modified to read:

 

A term of office on the Commission shall be three years and no member shall serve for more than two consecutive terms. The terms of Commission members shall be staggered so that two positions shall become open every third year. The term of office shall commence on January 1 and expire on December 31.

 

Section 4. Section 32.71 of the Code of Dunes City, is replaced with the following:

 

The Commission shall complete its action on all land use applications coming before it within 60 days of the application being deemed complete, unless a longer time is requested by the applicant. The Commission shall complete its action on all other requests within 60 days of the filing thereof, unless a shorter time is provided by order or ordinance.

 

            ADOPTED BY THE DUNES CITY COUNCIL THIS 8TH DAY OF APRIL, 2007.
